Inquiry #5: Section 14-6.03D(1) of the Project Special Provisions states that the CSB "Must be a qualified United State Fish and Wildlife Service (USFWS) Mohave Ground Squirrel (MGS) monitor" [Add also the part about CDFW] Does the CSB need to be an MOU/permitted bio (required for trapping) or can the CSB be a biologist capable of obtaining CDFW approval, upon review of the qualifications submittal, who can conduct visual surveys?

Inquiry #7: The ITP provided in the IH states that the "The Authorized Biologist(s) and/or Biological Monitor shall conduct compliance inspections a minimum of two times in a seven-day period, after clearing, grubbing, and grading are completed." The Project Special Provisions states that the Permit Compliance On-Site Monitoring will be conducted weekly. Will the CSB be monitoring twice a week? Is the CSB required to monitor after construction during replanting? If so, for how long?

Inquiry #8: Section 6.5 of the ITP states that "Monthly/Quarterly Compliance Reports shall be submitted to CDFW as identified..." The Project Special Provisions require only a Pre-construction survey report, Weekly monitoring reports, Annual monitoring report, and a Final monitoring report. Will the CSB also be responsible for Quarterly and Monthly Compliance reports?

Inquiry #9: District 8 has allowed projects without lime, with dry lime, and some with lime slurry marination. However, lime slurry marination is usually only required where aggregates have severe bonding issues with binder. The project area doesn’t seem to have such bad aggregates that lime slurry marination would be required (see past projects that didn’t require any lime). The Superpave specification was written to not mandate LAS or Lime and have the HMA producer check the aggregates to meet the P.I. spec and then test for TSR and meet the 70 ratio. Mandating lime slurry marination will significantly drive-up cost for the HMA without adding benefit of the pavement’s lifespan. Allow the HMA producer to meet the 70 TSR requirement with no additive, LAS, and/or dry lime under section 39-2.01B(2)(b).
