The stationing differs from P-2 Profile (Sheet No. 22) which reads 364+44.49 to 364+98.65. Please confirm which is correct and please provide any subsequent profile or section changes.

Inquiry #8: Per Incidental Take Permit included in the Information Handout, "Post- Construction, this temporary detour road will be removed, ground up, and used as cover for the permanent earthen shoulder backing on each side of the new State Route 41 roadway." Is it the state’s intent to utilize the material from the detour for shoulder backing. If so, please indicate where subsequent work is to be paid or provide a bid item.

Materials generated from the removal of the temporary detour are considered embankment and is the property of the contractor to incorporate into the work, dispose, or recycle in accordance with the contractor’s means and methods of performing the work. Inquiry #9: Per Standard Specifications, Section 19-9.03 , “Do not place shoulder backing containing RAP within 100 feet measured horizontally from a culvert, watercourse, or bridge.” If temporary detour materials including RAP is to be utilized for Shoulder backing, does the State presume the Temporary Aquatic Habitats mentioned in the CTS Habitat Impacts Map do not constitute “a culvert, watercourse, or bridge”?

Inquiry #10: Per Section 2-1.15B DISABLED VETERAN BUSINESS ENTERPRISES - Projects $5 Million or Less, contractors must “… Meet the goal shown in the Notice to Bidders...” to be found responsive. In concurrence with these parameters and in reference to disadvantaged business enterprises, does the 22% DBE Requirement posted on the Caltrans Advertisement Page also mean the goal must be met to be found responsive?

Response #2:The bidder must meet the DBE goal of 22% to be responsive. The bidder can also be responsive, if the Office of Civil Rights (OCR) determines that bidder made a good faith effort when the bidder did not meet the DBE Contract set goal.

Furthermore, if the bidder does not meet the goal and OCR determines that the bidder did not make a good faith effort, we offer the bidder a reconsideration hearing so they can explain or provide information to the reconsideration committee members on why they think they made a good faith effort. Based on the hearing results, if committee overturns OCR decision of a no-good faith effort, then the bidder is considered to be responsive.
