Inquiry #4: Per spec section 7-1.02K(6)(j)(iii) it states "The material on this job site: 1. Is not a hazardous waste. 2. Does not require disposal at a permitted landfill or solid waste disposal facility."

Note 4 on plans sheets E-10, E-11 & E-13 along with Note 2 on plan sheet E-14 states " Type Z-2 soil between stations xxx+xxx and xxx+xxx. Top 2.5' of fiber optic (FO) trench section in the above limits to be exported to a permitted disposal facility."

The special provisions Section 14 Environmental Stewardship replaces Section 14.11.08 with 14.11.08 Regulated Material Containing Aerially Deposited Lead. This section contradicts section 7-1.02 and requires more than just a lead compliance plan.

There is no pay item for excavation of Type Z-2 aerially deposited lead.

Please let me know how to proceed.
