Submit new inquiry for this projectInquiry #1: The Informational Handbook provides a CPA stating: “Every contractor and subcontractor conducting business on the Reservation and with a contract of $1,000.00 or more shall pay a one-time Employment Administrative Fee of four percent (4%) of the total amount of the contract per each contract.” However, other sections of the handbook, including page 54 and page 62, indicate that the TERO/Employment Administrative Fee will be paid by the State, not the contractor.
Could you clarify whether the CPA governs who is responsible for paying the TERO/Employment Administrative Fee? If the contractor is responsible, will the additional funds be reimbursed through a change order?

Inquiry #2: Specification section 10-1.03 Time constraints only allows for installation of Drain system #5 between October 1 - March 31. Based on anticipated award with subsequent start dates, this constraint may provide delays in planned sequencing of Stage work area 2 progressing expeditiously. Can DS 5 start date begin earlier if work area 1 actual completion is earlier than October 1?

Response #1:Construction on drainage system no. 5 cannot start before October 1. Per note 3 of staging plans work areas can be completed in any order. Bid as per current contract documents.

Inquiry #6: Refer to Information Handout. The TERO CPA requires certain hiring, preferences, and contracting procedures that are required (such as in page 80 Section 6.11, as an example) to be implemented post award. Please confirm Caltrans will allow deviations of the bid listing or other bid requirements due to the "post-award" process and the unknown of the TERO execution at bid time.

Inquiry #7: Refer to Information Handout. The TERO CPA Section 6.6(A) requires certain Indian workforace goals that are not shown. Is there an approxiate pertange or hours Caltrans has determined for the contractor at bid time? This will help establish a benchmark for all bidders.

Response #1:No, there is not an approximate percentage of hours determined by the Department per the contract. The hours are established per 6.6A of the Informational Handout.
